1. Introduction
Welcome to LibraryAid. These Terms of Service ("Terms") govern your access to and use of the LibraryAid platform, including our website, services, and applications (collectively, the "Service"). By accessing or using LibraryAid, you agree to be bound by these Terms.
2. Definitions
In these Terms, the following terms have these meanings:
- "LibraryAid", "we", "us", "our" refers to the company operating the LibraryAid service.
- "User", "you", "your" refers to any person or entity using our Service.
- "School Admin" refers to users with administrative privileges for a school account.
- "Student" refers to users with student-level access to the platform.
- "Content" refers to all information and materials available on our Service.
- "Subscription" refers to the paid service plan selected by a school.
3. Account Creation and Requirements
3.1 School Accounts
School accounts must be created by authorized representatives of the educational institution. The person creating the account represents that they have the authority to bind the institution to these Terms.
3.2 Student Accounts
Student accounts are created and managed by School Admins. Schools are responsible for obtaining appropriate consents from parents or guardians for students under 13 years of age in accordance with the Children's Online Privacy Protection Act (COPPA).
3.3 Account Security
You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach.
4. Subscription and Payment Terms
4.1 Subscription Plans
We offer various subscription plans with different features and pricing. Current pricing and plan details are available on our Pricing page.
4.2 Free Trial
New school accounts may be eligible for a 30-day free trial. At the end of the trial period, you will be billed according to your selected plan unless you cancel before the trial ends.
4.3 Payment
Subscription fees are charged in advance on a monthly or annual basis. All fees are non-refundable except as expressly set forth in these Terms or as required by applicable law.
4.4 Taxes
Subscription fees do not include taxes. You are responsible for paying all applicable taxes associated with your subscription.
4.5 Price Changes
We reserve the right to change our pricing. Any price changes will be communicated at least 30 days in advance.
5. Account Licensing and Verification
5.1 License Scope
Subscriptions are licensed per individual school or school district and are non-transferable. Each school within a district must be properly registered within the account.
5.2 Student Count Verification
Subscription plans are based on student enrollment numbers. Schools and districts agree to:
- Provide accurate student enrollment numbers during registration
- Update student counts if enrollment significantly changes
- Respond to annual verification requests within 30 days
- Provide enrollment documentation upon request
5.3 Account Sharing Prohibition
Sharing account credentials between schools, districts, or organizations is strictly prohibited. Each educational institution must maintain its own separate subscription. Violations may result in:
- Immediate account suspension
- Termination of service without refund
- Requirement to purchase separate subscriptions for each institution
- Automatic upgrade to appropriate tier based on actual usage
5.4 Usage Monitoring
We monitor account usage patterns to ensure compliance with subscription terms. Suspicious activity patterns (such as simultaneous access from multiple geographic locations or IP addresses) may trigger verification requests or account reviews.
5.5 Annual Verification
We may request annual verification of:
- Current student enrollment numbers
- School/district documentation
- Authorized user lists
Failure to provide requested verification within 30 days may result in service suspension until verification is completed.
5.6 Tier Adjustments
If your student enrollment exceeds your current plan's limits, you must upgrade to the appropriate tier. We reserve the right to automatically upgrade accounts and adjust billing if usage significantly exceeds plan limits.
6. Cancellation and Termination
6.1 Cancellation by You
You may cancel your subscription at any time through your account settings or by contacting us. Cancellations will take effect at the end of your current billing period.
6.2 Termination by Us
We reserve the right to suspend or terminate your access to the Service for violation of these Terms, non-payment, or any other reason at our discretion. We will provide notice of termination unless we determine that immediate termination is necessary.
7. Intellectual Property Rights
7.1 Our Intellectual Property
The Service and all content, features, and functionality, including but not limited to text, graphics, algorithms, logos, and software, are owned by LibraryAid and are protected by copyright, trademark, and other intellectual property laws.
7.2 License to Use
We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purposes in accordance with these Terms.
8. User Content and Conduct
8.1 User Content
You retain all rights to any content you submit through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for the purpose of operating and improving the Service.
8.2 Prohibited Conduct
You agree not to:
- Use the Service for any illegal purpose or in violation of any applicable laws
- Infringe on the intellectual property rights of others
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any part of the Service
- Use the Service to distribute harmful code or conduct security testing without authorization
- Harass, abuse, or harm another person
- Submit false or misleading information
9. Data Privacy and Security
We take data privacy seriously, especially when it comes to student data. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
9.1 COPPA Compliance
We comply with the Children's Online Privacy Protection Act (COPPA). Schools are responsible for obtaining verifiable parental consent for children under 13 as required by COPPA.
9.2 FERPA Compliance
We comply with the Family Educational Rights and Privacy Act (FERPA). We act as a "school official" with a legitimate educational interest in student data and will only use student information for authorized educational purposes.
10. Limitation of Liability
To the maximum extent permitted by law, LibraryAid and its affiliates, officers, employees, agents, partners, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill.
Our total liability for any claim arising from or related to these Terms or the Service shall not exceed the amount paid by you to LibraryAid for the Service during the twelve (12) months preceding the event giving rise to the liability.
11. AI-Generated Content and Reading Levels
11.1 AI-Generated Reading Levels and Educational Data
LibraryAid uses artificial intelligence technology to generate estimated reading levels, including but not limited to ATOS scores, Lexile levels, reading ages, and grade level assessments for books in our database.
You acknowledge and agree that:
- Reading levels provided by LibraryAid are estimates only and are not official determinations from Renaissance Learning (ATOS), MetaMetrics (Lexile), or other educational measurement organizations.
- AI-generated reading levels should be used for general guidance only and not as the sole basis for critical educational decisions.
- LibraryAid clearly identifies AI-generated reading level data as estimates within the platform.
- For critical educational decisions, you should verify reading levels with official sources such as Renaissance Learning's AR BookFinder or the Lexile Framework.
11.2 No Warranty for AI-Generated Content
While we strive for accuracy in our AI-generated reading levels, we make no warranties, express or implied, regarding the accuracy, completeness, or reliability of this information. LibraryAid specifically disclaims any liability for educational decisions made based solely on our AI-generated reading levels.
11.3 Third-Party Educational Data
When available, LibraryAid may display reading level data from third-party sources. This information will be clearly identified by its source. The use of third-party data is subject to the terms and conditions of the respective data providers.
12. Refund and Cancellation Policy
12.1 Refund Policy
We want you to be satisfied with LibraryAid. Our refund policy is as follows:
30-Day Money-Back Guarantee
If you are not satisfied with LibraryAid within the first 30 days of your subscription, you may request a full refund. To request a refund within this period, please contact us at support@libraryaid.net with your subscription details.
After 30 Days
After the initial 30-day period, subscriptions are non-refundable. However, you may cancel your subscription at any time, and you will retain access to LibraryAid until the end of your current billing period.
Pro-Rated Refunds
We do not offer pro-rated refunds for partial months or years. If you cancel your subscription, you will continue to have access to the service until the end of your current billing cycle.
Annual Subscriptions
Annual subscriptions are eligible for refund within the first 30 days only. After 30 days, annual subscriptions are non-refundable but may be canceled to prevent automatic renewal.
12.2 Free Trial Terms
Trial Duration
Your free trial lasts 30 days from the date of activation.
Automatic Billing
After your 30-day trial ends, you will be automatically charged the subscription fee for your selected plan unless you cancel before the trial period expires.
Trial Reminders
We will send you email reminders:
- 7 days before your trial ends
- 1 day before your trial ends
Cancellation During Trial
You may cancel your subscription at any time during the trial period with no charge. After the trial ends, standard cancellation terms apply as outlined in our Refund Policy.
Trial Limitations
- Free trials are limited to one per customer/organization
- Free trials are limited to one per email address
- We reserve the right to deny trial access to prevent abuse
Payment Authorization
By starting a free trial, you authorize us to charge your payment method at the end of the trial period. You will receive advance notice via email before any charges occur.
Trial Features
During your trial, you will have full access to all features of your selected plan.
Trial Abuse
We reserve the right to terminate accounts that abuse the trial system, including but not limited to:
- Creating multiple accounts for the same organization
- Using fake information to obtain multiple trials
- Repeatedly canceling and restarting trials
12.3 Cancellation Policy
You may cancel your subscription at any time through your account dashboard or by contacting support. Upon cancellation:
- Your subscription will remain active until the end of your current billing period
- You will not be charged for subsequent billing periods
- Your data will be retained for 30 days after cancellation, after which it may be deleted
- You may reactivate your subscription at any time by subscribing again
12.4 Requesting a Refund
To request a refund within the eligible period, please contact us at:

- Include: Your email address, organization name, and reason for refund
Refund requests are typically processed within 5-10 business days.
12.5 Exceptions
Refunds may be denied if:
- The request is made after the 30-day eligibility period
- There is evidence of abuse or violation of our Terms of Service
- The account has been suspended or terminated for policy violations
13. Modifications to Terms or Service
We may modify these Terms at any time. We will provide notice of significant changes through the Service or by sending you an email. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
We reserve the right to modify, suspend, or discontinue the Service or any part of it at any time, with or without notice.
